This boarding contract is made and entered into on this ______ day of ______ 2008, by and between Angie Barnes hereinafter designated as Stable Owner, and ________________, hereinafter designated as Horse Owner, and if Horse Owner is a Minor, Horse Owner's parent or guardian _________________.  Stable Owner agrees to accept Horse Owner's hores _____________, Reg. NO. ________for boarding, and, it is the plan and intention of the Horse Owner to board this horse.  For and in consideration of the agreement herinafter set forth, the Horse Owner and the Stable Owner mutually agree as follows:

1.  Horse Owner agrees that Stable Owner, Angie Barnes, their agents and employees are not liable for death, sickness, and/or accident including consequential damages caused to the horse, except if caused by the willful and wanton negligence of the Stable Owner completely harmless and not liable for any injury whatsoever caused to the Horse Owner, and/or loss or damages to any personal property.

2.  It is the responsibility of the Horse Owner to carry full insurance including coverage on the horse and all personal property.

3.  Horse Owner shall pay the Stable Owner for boarding sevices, as described below, the fee of $______ per month or $________ per day.  This shall include the following:

4.  The boarding fee is due on the first (1st) day of each month.  Any payment after the 5th, will be charged a $25.00 late fee.  In the event that payment is overdue by 30 days, and provided Stable Owner performs the services herein specified, Stable Owner is entitled to enforce lien and sell the hores for the amount due according to the appropriate laws of the state.  If and when horse is sold by Stable Owner, Horse Owner will pay Stable Owner all bills owing plus 10% of the selling price.

5. The horse shall be free from infectious, contagious or transmissible disease.  The following are required:

Stable Owner reserves the right to refuse horse within 14 days of arrival if not in proper health.

6.  Stable Owner reserves the right to notify Horse Owner within 14 days of horse's arrival if horse, in Stable Owner's opinion, is deemed dangerous or undesirable for a boarding stable.  In such case, Horse Owner is responsible for removing horse within 7 days and for all fees incurred during horse's stay.  After all fees have been paid, this Contract is concluded.

7.  Regular farrier and veterinarian attention is scheduled by Stable Owner and will be invoiced to the Horse Owner on the first of the month following the service.   An additional horse handling charge of $10.00 will be included in the billing.

8.  In the event the horse shall require the service of a veterinarian, after reasonable efforts have failed to contact Horse Owner, Stable Owner has permission to contact a veterinarian for treatment, with no liability whatsoever on the part of Stable Owner for such fees.

9.  In the event that the indoor arena is being used for lessons, the boarders should try to schedule ride time around the scheduled lessons.  Lesson schedule will be posted in the barn and on the web site.  www.topcreststables.com

10.  The hours of the stable are 9:00 a.m. to 8:30 p.m.

11.  Additional agreements should be separately initialed by each party.

12.  The Horse Owner must give the Stable Owner 30 days notice prior to leaving.  If a 30 days notice was not given the Horse Owner must pay the Stable Owner one months board, prior to leaving.

13.  This Contract represents the entire agreement between the parties.  NO other agreement or promises, verbal or implied, are included unless specifically stated in this written agreement.  This Contract is made and entered into the State of Michigan, and shall be enforced and interpreted under the laws of this state.  Should any clause be in conflict with State Law, then that cluase is null and void.
